Pursuant to Clause 4.5 of Article 4 of the Law on Higher Education is hereby RESOLVED to:
1. Approve “Regulation on Classification of Higher Education Institutions” as attached to this Order.
2. In connection with the issuance of this Order, consider invalid Order no.63 of 2003 “To approve regulation” and Order no.74 of 2007 “To amend and change Order”.
3. Assign Professional Development Department /M.Baasanjav/, Science and Technology Department /U.Sukhbaatar/ to monitor implementation of this Order.

REGULATION ON CLASSIFICATION
OF HIGHER EDUCATION INSTITUTIONS
One. General Provision
1.1. This regulation shall be applied to regulate relations related to determination of classification of higher education institutions in compliance with Article 15 of the Law on Education and Article 4 of the Law on Higher Education.
1.2. All higher education institutions conducting training activities regardless of their form of ownership shall be involved in process classification determination.
1.3. College shall fully meet the general requirements for higher education institution.
1.6. University with a type of Research-Training-Production Institution shall fully meet the general and additional requirements specified in Chapter 2 and 5 of this Regulation.
Two. General Requirement for Higher Education Training institution
Higher Education Training Institution should meet the following general requirements.
2.1. Legal Environment:
2.1.1. To have Board of Directors established in accordance with the sample procedure approved by the Member of Government in charge of education.
Board of Directors shall have its own regulation associated to school activities, developed in accordance with requirements of record keeping, tailored to school specifics and complied with the sample procedure.
2.1.2. To have Charter complied with the sample procedure approved by the Member of Government in charge of education.
Charter shall define organizational structure, responsibilities of main and subordinate units, identify whether institution is for-profit or non-profit and describe statutory fund. Ministry of Education, Culture and Science should be notified about amendments in Agreement of Establishment and Charter made in accordance with the relevant legislation, or changes of Charter and location of institution within 14 calendar days and recorded in state registration.
2.1.3. To have internal regulations in accordance with the relevant laws and regulations governing labor relations and internal activities.
2.1.4. To have employment contract between administration of institution and faculty member.
2.1.5. To have short-, medium-, and long-term strategic plan for development that defines its mission and objectives, and being accustomed to estimating direction and results of its implementation.
2.1.6. To have Code of Ethics for Faculty Members.
2.1.7. To have Student Contract executed with each student.
2.1.8. To have Code of Ethics for Students.
2.1.9. To be audited its financial operations every two year. Besides tuition fees, school budget shall have other financial resources permitted by law.
2.1.10. To have Development Fund. Charter of this fund shall be discussed and approved by Board of Directors.
2.1.11. To have Higher Education Diploma Award Regulation and diploma template approved by the Ministry of Education, Culture and Science.
2.1.12. College shall have Training and Methodological Council. Training and Methodological Council shall have its own rule.
2.1.13. To have Library Rule.
2.1.14. To have Students’ Dormitory Rule.
2.2. Organizational structure:
2.2.1. Department or Laboratory is the main unit of higher education institution.
2.2.2. To have unit or full-time staff in charge of training quality assurance, monitoring and evaluation.
2.2.3. Student Enrollment Regulation shall be approved and followed annually.
Controlled enrollment number of students approved for each year by the Ministry of Education, Culture and Science must be followed.
2.2.4. To have training plan and curriculum for each training form, professional direction /index/ to be reviewed and approved by the Ministry of Education, Culture and Science. To have approved course schedule to be followed during academic year. To introduce academic credit system in compliance with regulation.
2.2.5. To assess knowledge and skills of students in accordance with procedures established by the Ministry of Education, Culture and Science.
2.2.6. To follow Rules on Organization of Training and Internship Program approved by Director of institution.
2.3. Teaching staff:
2.3.1. To introduce and implement a procedure for calculating workload of faculty members. It shall specify workload of faculty member required to conduct training, research, promotion and dissemination of culture and education to professional entities, institutions and citizens.
2.3.2. At least 75 percent of all teaching staff should be employed full-time.
/Full-time faculty member is a teacher employed by the Order of Institution Director in accordance with the Clause 13.3 of Article 13 of the Law on Higher Education, paid in accordance with public service salary network /if state-owned school/, who pays social insurance contribution through institution and executes training, research, promotion and dissemination of culture and education to professional entities, institutions and citizens. /
2.3.3. Faculty member must hold at least Master’s Degree.
2.3.4. One faculty member should teach no more than 3 courses per semester.
2.3.5. Faculty member shall follow a Job Description developed within the scope of Employment Contract.
2.3.6. Working conditions stipulated in Job Description shall be fully provided by Institution.
2.4. Students:
2.4.1. Students shall have own governing body /Students’ Union or Council/ to protect their rights, interest and represent them.
2.4.2. Students’ self-governing body shall have office and budget to operate. It shall regularly perform activities directed to receive discount for public transportation, access to health service, get internship by pursuing specialization and intermediate in employment.
2.4.3. Institution shall own students’ dormitory and it shall fully meet the requirements of Students’ Dormitory Standard approved by the National Agency for Standardization and Metrology.
2.4.4. Institution shall execute contract with relevant organization to provide students with accommodation if it does not have own dormitory for students.
2.4.5. There are should be regular social, cultural and sport events for student, lectures, seminars and other events on prevention of infection diseases and harmful social habit to be held each season and specialized courses and clubs by pursuing specialization.
2.4.6. Institution shall approve and implement relevant legal documents to grant tuition discount based on student achievement. Implementation shall be reported to representative body of students.
2.4.7. Institution shall have unit or staff to provide jobs for graduates and intermediate in employment. Institution shall conduct graduate job survey and regular tracer study on graduates’ employment after 6 months and one year from their graduation.
2.5. Learning environment and facilities:
2.5.1. Institution shall own facility for training purpose meeting requirements of area size and hygiene standard specified in the Civil Construction Standards. Possess Real estate registration certificate, and own training facility transferred from Founder of Institution.
2.5.2. Land possessed by Institution should have a cadastral map and registered and certified by the relevant authority. Land for training purpose should not be used for other economic activities.
2.5.3. Professional laboratory for training shall be established and equipped in accordance with standard requirements.
2.5.4. Institution facilities should have stairs and toilets for disabled people, faculty members and students.
2.5.5. Institution should have public catering service spot which meets hygienic requirements.
2.5.6. Institution should have sport gym which meets standard requirements. If there is no sport gym, institution shall execute contract to rent gym for organization of sport trainings.
2.5.7. Institution should have room to store documents connected with its activity, and employ professional responsible for this work.
2.5.8. Number of students should commensurate with the capacity of institution. Shift utilization ratio should be no more 1.5. / Shift utilization ratio calculated by dividing total number of students by number seat. /
2.5.9. Institution should have a library which meets the “Requirements for library environment and operation” approved by National Agency for Standardization and Metrology in 2007. Library shall have database with electronic catalog and fund to use in electronic form.
2.5.10. Library shall keep records of forms and registration sheet of Library Reading and Service approved by the Order no.441 of 2005 of the Minister of Education, Culture and Science.
2.5.11. Institution should employ professional librarian.
2.5.12. The fire safety requirements of the building shall be met.
2.6. Information Technology:
2.6.1. Information technology shall be used in institution and training activities.
2.6.2. Trainings for specializations shall use related and special applications.
2.6.3. Institution shall use software to run continuously School Management Information System.
2.6.4. Each faculty member should have e-mail address and webpage to use in training activities.
2.6.5. Each student should have e-mail address.
2.6.6. Institution should have dynamic website and information posted on it should be constantly updated.
2.6.7. Organization of computer training should allow no more than 2 students to use one computer at the same time.
2.6.8. Faculty members should be provided with computers and high-speed internet connection. It may be allowed to use one computer by two teachers.
2.6.9. All training materials should be transferred to electronic form.
2.6.10. Institution which conducts training on business management should have content on e-commerce in curriculum.
Three. Requirements for Institutes
3.2. If Institution runs Master’s degree training, Master’s degree courses should be taught by faculty members with PhD Degree.
3.3. At least 15 percent of full-time faculty members should hold PhD Degree.
3.4. Institute shall have a research unit where its carries out researches in specific area of science.
Unit shall regularly evaluate research papers of students and faculty members, provide support for further research and encourage participation of students and faculty members in scientific conferences.
Four. Requirements for University
4.1. University is a legal entity which operates in accordance to Clause 4.2 of Article 4 of the Law on Higher Education.
4.2. University should conduct doctoral degree trainings at least in 3 specializations. It shall have a unit in charge of master’s and doctoral programs. All courses related to these programs should be taught by faculty members with PhD Degree.
4.3. University may have organization unit based on teams of professors.
4.4. At least 70 percent of all faculty members should be engaged in research activities.
4.5. At least 30 percent of full-time faculty members should hold doctoral degree.
4.6. At least 40 percent of all students should be engaged in research activities.
4.7. University shall have Academic Council. At least 50 percent of all members will be representatives of University and the rest will representatives of business entities, government and non-government organizations and scientists. At least 70 percent of Academic Council members should hold doctoral degree.
4.8. In case of state-owned university of technology, not less than 10 percent of research should be performed in the field of high technology out all research and development works done at university.
4.9. University shall have several specialized laboratories in related fields of science.
4.10. Domestic and foreign scientific journals should constitute at least 5 percent of total book fund of University library.
4.11. University shall publish research journals independently or in collaboration with other universities and research institutions.
4.12. Total number of works published in foreign scientific journals and inventions with intellectual property certificate and patent should not be less than 3 percent of all scientific works.
4.13. University should regular organize scientific conferences and seminars according to prepared programs.
4.14. University may have a fund to support and further develop research works of faculty members and students. Financial sources of fund will be legally agreed investments, donations and assistance from foreign and domestic citizens and organization. Board of Directors shall approve procedure to regulate activities of fund after receiving comments from the relevant authority.
Five. Additional Requirement of University with
Research-Training-Production type
5.1. University should meet the evaluation requirements approved by the Order no. 463 of the Minister of Education, Culture and Science date on December 4, 2007.
5.2. University shall have at least 3 production units operating in accordance with research works and at least 3 research institutes.
Six. Classification Determination Process
6.1. Higher education institution applying for classification determination shall submit the following documents to higher education unit of the Ministry of Education, Culture and Science.
а/ Application
б/ Grounds that higher education institution meets requirements of particular classification, introduction, copies of state registration certificate license to conduct training activity, detailed report describing how general and additional requirements are met.
6.2 Higher education unit of the Ministry of Education, Culture and Science shall check composition of submitted documents and shall appoint a Working Group of experts by the Order of the Minister of Education, Culture and Science if submitted documents are complete.
Incomplete documents shall be returned to applicant.
6.3. Heads and specialist of units specialized in higher education, finance, monitoring, evaluation and law of the Ministry of Education, Culture and Science, heads and state inspectors of units in charge of higher education, labor and finance of the Specialized Inspection Agency, qualified staff of the state central and city libraries, directors and qualified staff of higher education institutions, representatives of student and research organizations shall appoint Working Group members. Representatives of the training sector may be invited to work in Working Group.
6.4. Experts shall produce conclusion. If 90 percent or more percent of evaluated points scored as “sufficient”, final score will be “sufficient”.
6.5. Working group of experts shall introduce its conclusion to the Meeting of Heads of Units of the Ministry of Education, Culture and Science
6.6. Based on conclusion of Working group and minutes of the Meeting of Head of Units of the Ministry of Education, Culture and Science, the Minister of Education, Culture and Science shall issue an Order.
6.7. If it is confirmed by results of examination held by Specialized Inspection Agency and the Ministry of Education, Culture and Science, that particular higher education institution is not competent to classification, classification of higher education institution shall be lowered by decision of the Minister of Education, Culture and Science.
